Required Sections
A legally enforceable waiver should include all of the following:

Activity description: clear description of the activity and its inherent risks

Assumption of risk clause: acknowledgment that the participant understands and accepts the risks

Release of liability: agreement not to hold the organization liable for injuries or damages

Indemnification clause: agreement to cover costs if the participant causes harm to others

Medical authorization: permission to seek emergency medical treatment if needed

Signature and date: legally binding signature (electronic signatures are valid in most jurisdictions)

Legal Tips

Use plain language: courts have invalidated waivers that were too complex for the average person to understand.

List specific risks: generic "all risks" language is weaker than naming concrete hazards (falls, equipment failure, etc.).

Collect electronic signatures: they carry the same legal weight as ink signatures under ESIGN and eIDAS.

Include a severability clause: if one section is ruled invalid, the rest of the waiver remains enforceable.

Have a lawyer review your template before widespread use: state and country laws vary significantly on enforceability.
